Present second petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No.

FIR in the present case was registered at the instance of complainant Virender Singh, alleging therein that on 28.01.2023 at about 9:00 PM, while he along with his brother-in-law - Ram Gopal Sharma was out for an evening walk, a black coloured Innova vehicle approached them. Three young men, identified as (i) Lakhwinder Singh @ Lakha s/o Bittu, (ii) Sanjay @ Sanju s/o Amarjit and (iii) Surjit Singh @ Jeeta (petitioner herein) s/o Satnam Singh, alighted from the vehicle and allegedly launched a brutal assault upon Ram Gopal with wooden logs, causing grievous injuries on his head and upper body. One more accused, namely Sandhu, remained seated in the vehicle. Injured was taken to hospital where he was declared dead. CRM-M-67018-2025 - 2 - the complainant is that deceased - Ram Gopal Sharma, used to object and stopped the accused from selling drugs and indulging in illegal drug related activities.

Petitioner is in custody since 21.05.2025 and after framing of charges on 30.11.2024, trial has commenced. Out of total 33 prosecution witnesses, 03 witnesses have already been examined. However, as noticed in paragraph No.6 of the status report, petitioner was not cooperating during the course of trial and was even declared a proclaimed offender on 25.07.2023. 4.

There are specific allegations against petitioner that he, along with other co-accused persons, assaulted the deceased with wooden logs resulting in the death of Ram Gopal Sharma, who, as per allegations, used to object to the accused selling drugs and indulging in illegal drug-related activities.

Taking note of the aforementioned circumstances and the nature and gravity of allegations, the instant second petition seeking regular bail filed by the petitioner is hereby dismissed.

At this stage, learned counsel for petitioner seeks permission to withdraw the present petition.
