The present petition has been filed seeking issuance of appropriate direction to respondents No.2 to constitute SIT to investigate the matter arising out of (1) FIR No.72 dated 01.08.2025 under Sections 308(2), 127(2), 3(5) B.N.S., Police Station City Ahmedgarh Malerkotla, Annexure P-1, and (2) FIR No. 75 dated 05.08.2025 u/s 108 of BNS, 2023 Police Station: City Ahmedgarh, District Malerkotla, Annexure P-2, and to submit the report in a time bound manner.

It is further argued that no suicide note has been recovered and the statement of the victim, namely Abhishek in the above-said FIRs, has also not been recorded. Learned counsel submits that the petitioners are law abiding citizens, who have been falsely implicated in frivolous FIRs. There are material contradictions between the two FIRs, particularly with regard to the number of persons involved and the manner in which the alleged victim-Abhishek, had managed to escape. It is also contended that the petitioners had submitted a detailed representation (undated) to the Senior Superintendent of Police, Malerkotla, detailing out the entire factual matrix of the case, which was dispatched on 19.11.2025, but the same has not been duly considered by the authorities.

Per contra, learned State counsel submits that the correct factual position is that victim-Abhishek, was travelling with petitioners' sister Meenakshi (wife of Manish Verma) on 31.07.2025, when he was allegedly kidnapped. The incident was immediately reported to victim's father, who lodged an FIR, and the child was subsequently recovered on the same day. It is further submitted that the present petitioners, being the brothers and sisters-in-law of the deceased, visited her residence and allegedly admitted before her their involvement in the kidnapping. contended that the deceased being unable to cope with the situation and the acts attributed to the petitioners, was in severe mental trauma, due to which she ultimately took such an extreme step of committing suicide. 5.
Learned State counsel further submits that the petitioners had been absconding and were arrested only on 06.03.2026, and the investigation is underway. It is argued that the present petition has been filed only to exert undue pressure upon the investigating agency. Moreover, that the authorities are examining the matter from all relevant aspects and is proceeding in accordance with law.

Considering the fact that there are serious allegations against the petitioners, particularly with regard to the abduction of a minor for ransom and the subsequent commission of suicide by the petitioners' sister due to the mental trauma allegedly inflicted upon by the petitioners' with their act and conduct. This Court is of the view that the matter requires thorough investigation. Moreso, as the petitioners are arrested only on 06.03.2026 and as per the statement of learned State counsel that the matter is being duly investigated from all aspects.

Accordingly, finding no merit in the present petition, the same is accordingly dismissed.
