Present petition has been filed, under section 482 B.N.S.S., 2023 (Equivalent to Section 438 Cr. P.C.) for grant of anticipatory bail to the petitioners in case registered, vide FIR No.236 dated 22.10.2025 under Sections 115(2), 118(1) and 3(5) of BNS, 2023 (Section 118 (2) of BNS added later on), at Police Station Shahkot, District Jalandhar. 2.
On 26.11.2025, following order was passed:- "1.
Petitioner - Surinder Kaur, aged 73 years, and Major Singh, aged 69 years, who are related as parents-in-law of complainant - Gurmeet Kaur, have filed CRM-M-663062025, for seeking anticipatory bail. 2.
Petitioner - Kuldeep Singh, aged 44 years is related as husband of the complainant and has filed CRM-M-663252025, for seeking anticipatory bail.

All the aforementioned three petitioners have been named as accused, in case, FIR No.0236, dated 22.10.2025, under Sections 115(2), 118(1) and 3(5) of BNS, 2023 (Section 118(2) of BNS added later on), registered at Police Station Shahkot, District Jalandhar.

Complainant-Gurmeet Kaur was earlier married to one Harjinder Singh and from that marriage, she was blessed with a daughter, Khushpreet Kaur. About 4-5 years ago, complainant obtained a divorce from Harjinder Singh and subsequently married petitioner Kuldeep Singh (in CRM-M-66325-2025) in June 2025.

As per the allegations in the FIR, the incident occurred on 09.10.2025, when the complainant was chopping vegetables in the kitchen and her parents-in-law began hurling abuses at her, leading to an altercation among the family members. It is alleged that her husband Kuldeep Singh, who was in an inebriated condition, snatched the knife from her hand and inflicted injuries on her left hand. Petitioner-Surinder Kaur is alleged to have dragged the complainant by pulling her dupatta around her neck, while petitioner-Major Singh is stated to have given her fist blows. On account of the incident and the injuries allegedly sustained, offence was initially registered under Sections 115(2), 118(1), and 3(5) of the BNS, 2023; however, after about one month, i.e., on 09.11.2025, Section 118(2) of the BNS, 2023 was also added.

Learned counsel for the petitioners submits that although the alleged incident occurred on 09.10.2025, FIR was lodged belatedly on 22.10.2025 after concocting the allegations. It is argued that complainant did not suffer any such injury as alleged and the medical opinion obtained after one month is yet to be established, as genuine.
It is further submitted that the dispute is purely familial in nature and arose out of sudden provocation allegedly caused by the complainant herself, who is wife of petitioner-Kuldeep Singh. Injury, being on a non-vital part of the body, is not of grave nature, and incarcerating the petitioners on such technicalities, may further aggravate the strained relationship between the parties. Thus, counsel prays for grant of anticipatory bail to the petitioners in the present case.

On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance on behalf of the respondent - State, and seeks some time to file status report in the matter. 9.

Meanwhile, the petitioners (in both the cases) are directed to join the investigation as and when required to do so by the Investigating Agency. In the event of their arrest, the petitioners shall be released on ad-interim bail, subject to their furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioners shall also abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).

Besides, it is directed that petitioners would hand over their passport to the Investigating Agency or to Court concerned, if they possess. Otherwise, would submit an affidavit, disclosing the fact that they do not possess any passport.
It is also directed that before leaving country any time during trial, petitioners would seek prior permission of the Court.

A photocopy of this order be placed on the file of other connected case."

Continuing his submissions, learned counsel for the petitioners contends in compliance with the order dated 26.11.2025 passed by the Court, petitioners have joined the investigation and has extended full cooperation. Therefore, he prays for confirmation of the said interim anticipatory bail order.

Learned State counsel on instructions from ASI Sukhwinder Singh Singh, confirms the said averment made by counsel for the petitioners of joining investigation on 20.12.2025 by the petitioners, and submits that as of now, custodial interrogation of the petitioners are not required for the purpose of investigation.

Heard learned counsel for the parties.

Since, petitioners have already joined the investigation and custodial interrogation is no more required; ad-interim bail order dated 26.09.2025, passed by the Court is hereby made absolute. Accordingly, present petition is allowed.
However, petitioners shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. 7.
Accordingly, petition stands disposed of.
However, present order would be subject to the submission of their passport to the Investigating Agency or to Court concerned, if they possesses, within a period of one week from today. Otherwise, they would submit an affidavit, disclosing the fact that they does not possess any passport.
