The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to official Respondent No.2 and 3 to cancel his Other Backward Class (OBC) Certificate dated 13.07.2018 as he belongs to Creamy Layer and does not fulfil the criteria of OBC as per Notification dated 16.07.2024. He is further seeking direction to respondent No. 2 and 3 to decide his representation dated 03.10.2025.

The petitioner was issued an OBC certificate dated 13.07.2018 by Respondent No.3. He claims that said certificate was wrongly issued upon verification by the Secretary when he was minor. During assessment year 2017-18 when the certificate in question was issued his mother's income was ₹ 14,49,202/-. His parents' annual income for the assessment year 2025-2026 was ₹ 34,18,240/-. CWP-35202-2025 -2to take undue benefit of the same. He preferred representation dated 03.10.2025 before Respondent No.2 and 3 but to no avail. The State Government through Welfare of Scheduled Castes and Backward Classes has issued notification dated 16.07.2024 specifying criteria for exclusion of creamy layer within Backward Classes.

As per reply, OBC Certificate was issued on 13.07.2018, in view of present financial status of the petitioner's family and notification dated 22.03.2022 issued by State Government has become invalid. The said certificate was valid till 31.03.2019 i.e. current financial year. 4.

Learned counsel for the petitioner seeks permission to withdraw the petition at this stage with liberty to file afresh with better particulars.
