The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondent No.3 to register Transfer Deed in view of State Government Notification permitting registration of unauthorized colonies up to 31.08.2025. 2.
On 28.11.2025, the following order was passed by this Court:
"Counsel for the petitioners states that petitioner had applied for registration of the transfer deed online on 27.08.2025 before cut-off date of 31.08.2025. His grievance is that transfer deed is not being registered as approval was given by Sub-Registrar on 01.09.2025, Annexure P-6.
Advance copy of the petition has been served upon the official respondents.
State counsel requests for deferment to get instructions.
List on 15.01.2026."

Learned State counsel submits that as per paragraph No.2 of notification dated 25.11.2024, petitioners were required to get their property registered before 31.08.2025. There was another condition that DEEPAK BISSYAN 2026.03.23 16:52 I attest to the accuracy and integrity of this document

On being asked, learned counsel for the petitioners submits that document which was sought to be registered was executed prior to 31.07.2024 and as per extended date it could be registered up to 31.08.2025.

From the perusal of record, it is evident that petitioners applied for registration of sale deed on 27.08.2025. On 27.08.2025, petitioners complied with condition of registration prior to 31.08.2025, however, there is nothing on record disclosing that sale deed/agreement to sell which was sought to be registered was executed prior to 31.07.2024. In the absence of any evidence on record, this Court cannot return finding with respect to compliance of cut-off date 31.07.2024, however, if agreement to sell/sale deed was executed prior to 31.07.2024, the petitioners were entitled to registration because they had applied for registration prior to conceded cut-off date i.e. 31.08.2025. 6.
In the backdrop, respondents are hereby directed to reconsider petitioner's claim in the light of above observations. 7.
Disposed of.

The petitioners are hereby directed to appear before Sub Registrar, Ludhiana (West) along with requisite document on 30.03.2026 and thereafter as directed by said authority. 9.
Let the needful be done within six weeks from today. 10.
