CORAM:
HON'BLE MR. JUSTICE SANJAY VASHISTH.
Present:
Mr. Dharminder Kumar Sihav, Advocate, for the petitioner(s) (in all cases).
Mr. Manjinder S. Bhullar, DAG, Punjab.
**** SANJAY VASHISTH, J (ORAL) 1.
This order shall dispose of CRM-M-66716-2025, CRM-M66722-2025 and CRM-M-12692-2026, as all these petitions are interconnected and have arisen out of same FIR. However, the lead case is CRM-M-66716-2025.
Prayer in these petitions, filed under Section 482 of BNSS, 2023 (corresponding to Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner(s), who have been booked for having committed the
- 2 - offences punishable under Section 318(4), 61(2) of BNS, 2023, in a case arising out of FIR No.171, dated 16.10.2025, registered at Police Station City Fazilka, District Fazilka.
While hearing all three petitions on 28.11.2025 and 10.03.2026, respectively, following orders were passed by this Court:- "CRM-M-66716-2025 & CRM-M-66722-2025 1.
Present petitions have been filed by the petitioners, seeking grant of anticipatory bail, in case, FIR No.171, dated 16.10.2025, under Sections 318(4), 61(2) of BNS, registered at Police Station City Fazilka, District Fazilka.
Learned counsel for the petitioners, inter alia, contends that even if the allegations are taken at face value, it appears that the complainant, driven by the greed of multiplying his money running into lacs, invested the amount voluntarily and of his own free will. It is submitted that complainant, Sarabjeet Singh, is an educated person who, after allegedly suffering financial losses, has now concocted a false story with the intention of recovering the said amount by exerting undue pressure on the petitioners and the other accused persons.
It is further argued that no amount was ever deposited into the bank accounts of the petitioners. Rather, the complainant himself invested money in the hope of earning substantial profits by participating in betting on IPL 2025 matches, using his own mobile numbers, i.e. 99140-53918, 9915555679, and other numbers. Moroever, petitioners are willing to join the investigation and extend full cooperation, provided they are afforded protection from arrest. Thus, counsel prays for the grant of anticipatory bail to the petitioners.
4.
Notice of motion.
On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance on behalf of the respondent - State, and seeks some time to file status report in the matter.
Adjourned to 02.02.2026.
Meanwhile, the petitioners are directed to join the investigation as and when required to do so by the Investigating Agency. In the event of their arrest, the petitioners shall be released on ad-interim bail, subject to their furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioners shall also abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.). Besides, it is directed that petitioners would hand over their passport to the Investigating Agency or to Court concerned, if they possess. Otherwise, would submit an affidavit, disclosing the fact that they do not possess any passport.
It is also directed that before leaving country any time during trial, petitioners would seek prior permission of the Court. A photocopy of this order be placed on the file of other connected case.

Learned counsel for the petitioner, inter alia, contends that even if the allegations are taken at face value, it appears that the complainant, driven by the greed of multiplying his money running into lacs, invested the amount voluntarily and of his own free will. Counsel submits that complainant-Sarabjeet Singh, is an educated person who, after allegedly suffering financial losses, has now concocted a false story with the intention of recovering the said amount by exerting undue pressure on the petitioners and the other accused persons. Counsel also contends that no amount was ever deposited into the bank accounts of the petitioner. Rather, complainant himself invested money in the hope of earning substantial profits by participating in betting on IPL 2025 matches, using his own mobile numbers, i.e.
99140-53918, 99155-55679, and other numbers.
