On 05.03.2024, the Assistant Collector Ist Grade-cum-Sub Divisional-Officer (Civil), Assandh, District Karnal (for short-the A.C.) ordered the petitioner's eviction from the land in question. The said order was challenged by the petitioner through filing of a statutory appeal before the Collector. Along with his appeal, an application for interim stay was also filed but before the petitioner's aforesaid appeal or application for stay could be taken up for final disposal by the Collector, in execution of the order of the A.C. dated 05.03.2024, the petitioner has been asked to vacate the land in question. In these circumstances, the petitioner has filed the instant petition seeking therein issuance of a direction to the Collector to finally dispose of his appeal or at least his prayer for interim stay in a time bound manner and in the meanwhile, protect his possession over the land in dispute. 2.

At the outset, learned State counsel submits that the petitioner's aforesaid appeal shall be decided by the Collector within three months from the next date fixed before it.

CWP-35238-2025 -2and therefore, dispose of this petition with a direction to the Collector to decide the petitioner's appeal filed by him to challenge therein the order of the A.C. dated 05.03.2024 within three months from the next date fixed before it but only after granting opportunity of hearing to all affected parties and in accordance with law. 4.

Till the decision, as above, is taken by the Collector, the petitioner's possession over the land in question shall not be disturbed. 5.

It is further directed that the Collector shall decide the petitioner's appeal without being influenced by the interim protection granted by us through this order.
