The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of complaint dated 14.05.2018 bearing No. NACT/105/2018 under Section 138 of Negotiable Instruments Act pending trial before JMIC Dasuya and all the subsequent proceedings arising therefrom, on the basis of compromise dated 12.11.2025.

Learned counsel for the petitioner submits that the matter has been compromised between the parties.

Mr. Rahul Paul, Advocate appears and accepts notice on behalf of the respondent in the Court. He has filed the affidavit on behalf of the respondent in the Court today and the same is taken on record. He confirms the factum of the compromise having been effected between the parties and states that the respondent has no objection to the quashing of the FIR in question. In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 6.

Accordingly, the petition is allowed and complaint dated 14.05.2018 bearing No. NACT/105/2018 under Section 138 of Negotiable Instruments Act pending trial before JMIC Dasuya and all the subsequent proceedings arising therefrom shall stand quashed qua the petitioner on the basis of compromise dated 12.11.2025 subject to payment of costs of Rs.5,000/- to be deposited with Rashtriya Bal Swasthya Karya bearing Account No. 917010075030711 IFSC Code UTIB0001518 Branch Name State Bank of India, Sector-16, Chandigarh.
