(Oral) Though, reply has been filed at the instance of the respondent, but however, the counsel for the respondent, at this stage, submits that the respondent has no objection, if the transfer application is accepted and the divorce petition is transferred from Gurdaspur to SAS Nagar (Mohali). However, counsel submits that since the respondent is private practitioner and is running a private clinic at Gurdaspur, he has made arrangement for his job in such a manner that he can travel and attend the court proceedings on Thursday only. Counsel for the applicant heard.

In view of the submissions aforesaid made by the counsel for the respondent, it is also pertinent to make mention that from the contents of the application, it is evident that there is one child, born from the wedlock of the parties, who is about 4 1⁄2 years old and is stated to be in the care and custody of the SONU 2026.02.17 09:55 I attest to the accuracy and authenticity of this document

TA-1579-2025 respondent. The applicant is not having any source of earning and the distance between the two places is about 250-300 kms.

Considering the aforesaid circumstances, together with the statements made by the counsel for the respondent, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/639/2025, titled 'Dr.Sahil Mahajan v/s Shabnam Malik @ Simran', filed by the respondenthusband, stands transferred from the Family Court, Gurdaspur, to the Court of competent jurisdiction at SAS Nagar. The requisite record of the aforesaid case be sent by the Family Court, Gurdaspur, to the District and Sessions Judge, SAS Nagar.

Learned District and Sessions Judge, SAS Nagar, shall assign the said petition to the Family Court, SAS Nagar. Even, the parties are directed to appear before the Family Court, SAS Nagar, within a period of one month from today onwards.

However, the court concerned, where the case is transferred by the District and Sessions Judge, SAS Nagar, is hereby requested to give the dates to the parties, to their convenience and preferably only on Thursday, as submitted by the counsel for the respondent, before this court today.
