The present petition has been filed by the petitioner for grant of anticipatory bail in case arising out of FIR No.264, dated 06.11.2025, registered under Sections 307, 126(2), 115(2), 191(3), 190, 324(4) and 61(2) of the BNS, at Police Station City-I, Abohar, District Fazilka. 2.

Vide order dated 01.12.2025, passed by this Court, the petitioner was granted interim bail and directed to join investigation. 3.

Status report has been filed. Learned State counsel on instructions from the Investigating Officer has submitted that the petitioner has joined investigation on 06.12.2025. She further submits that however, arrest of the co-accused is still pending and custodial interrogation of the petitioner is required.

Given the nature of the allegations as levelled against the petitioner as well as the above discussed facts, this Court is of the considered opinion that pendency of the arrest of the co-accused cannot be considered to be a reason for denying benefit of bail to the petitioner. Accordingly, no case for pre-trial incarceration of the petitioner is made out. Pre-trial incarceration even otherwise should not be a replica of post conviction sentencing. Taking into consideration the above discussed facts, this petition is allowed and the order dated 01.12.2025 granting interim bail to the petitioner is made absolute, subject to compliance of conditions laid down in Section 482(2) of BNSS.
