, -./ The present petition has been filed seeking directions to the respondent No.4-District Magistrate, Fatehgarh Sahib to take a decision on the application submitted by the petitioner for grant of parole bearing Reference No. 3162 dated 27.08.2025 which is pending after the order of remand dated 14.10.2025.

Counsel for the petitioner contends that the petitioner was convicted and sentenced in case bearing FIR No. 89 dated 14.04.2019 registered under Sections 22, 29/61/85 of the NDPS Act, at Police Station Sirhind, District Fatehgarh Sahib for being in conscious possession of contraband and intoxicant injections of make Buprenorphine (Bupine) 2 ml each bearing batch No. 3B19001 and having Mfg. Date 01/2019 Exp. Date 12/2020 and one intoxicant injection of Buprenophine (Rexogesic) 2 ml having batch No. RX139 Mfg. Date Jan. 2019 Exp. Date Dec. 2022 and sentenced to undergo rigorous imprisonment for a period of 05 years for commission of offence under Section 22 (b) NDPS Act. It is contended that the petitioner has already undergone an actual custody of nearly 08 months VISHAL SHARMA 2025.12.06 13:14 I attest to the accuracy and integrity of this document

CRWP-12940-2025 -2-  including the period as an undertrial. He applied for grant of 04 weeks parole as per Section 3 of Punjab Good Conduct Prisoners (Temporary Release) Act, 1962 and the same was forwarded through dispatch letter No. 3162 dated 27.08.2025. The District Magistrate, Fatehgarh Sahib forwarded parole request/letter to the office of Superintendent of Police, Fatehgarh Sahib for verification. A report was submitted giving a negative recommendation for grant of parole. The District Magistrate showed his disagreement with the report as was not based on any evidence/detailed enquiry and a fresh verification report was sought for, however, despite lapse of more than a month thereafter, no decision has been taken upon the same. He contends that he may be satisfied at this juncture in case the respondent No.4-District Magistrate-Fatehgarh Sahib is directed to take expeditious decision on the parole application. 3.

Learned State Counsel contends that he would have no objection to the same.

The present petition is accordingly disposed of at this juncture, with the consent of the parties and without commenting on the merits of the present case with a direction to District Magistrate, Fatehgarh Sahib to take a decision on the pending application for grant of parole within a period of six weeks of receipt of certified copy of this order.
