Learned counsel contends that name of the petitioner surfaced based on the disclosure statement of co-accused Ashiq Ali, from whom 10 buffaloes are stated to have been recovered which were handed over to the police on the same very day i.e. 29.08.2025, however, FIR came to be registered on the next day at 9.30 am. He alleges false implication due to previous enmity with the aforesaid co-accused as he had committed theft of the buffaloes of the petitioner as well for which a complaint has been submitted to the members of the community who reprimanded him. He is ready and willing to join the investigation as and when required by the investigating agency and will cooperate.

CRM-M-67134-2025 (O&M) -2Meanwhile, the petitioner is directed to join the investigation on or before 10.12.2025. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) BNSS.

However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.
