Present petition has been filed by the petitioner under Section 528 of BNSS for quashing/setting aside the impugned order dated 19.01.2023 passed by learned Sub Divisional Judicial Magistrate, Nakodar, in a case bearing FIR No.90 dated 22.05.2020, registered under Sections 323, 341, 148, 149, 188, 269, 270 of IPC and Section 51 of Disaster Management Act, 2005, at Police Station Sadar Nakodar, District Jalandhar, vide which, petitioner has been declared proclaimed person. 2.

Learned counsel for the petitioner submitted that the present FIR was registered on 22.05.2020 and petitioner went abroad on 21.06.2022. Due to that, he failed to appear before the trial Court, now the petitioner is ready to surrender himself before the learned trial Court and prays that the petitioner be not arrested by the police.

Mr. Anup Singh, AAG, Punjab, puts in appearance as advance copy of petition had been served to respondent-State and submitted that the petitioner failed to appear before the trial Court despite his knowledge, he absented from the Court and declared proclaimed person. 5.

Having heard learned counsel for the petitioner as well as learned State counsel, this Court finds no merit in the present petition. The case was registered on 22.05.2020, and despite being fully aware of the pending proceedings. The petitioner had appeared before the trial Court and furnished bail and surety bonds regarding his appearance on each date of hearing, clearly demonstrating his knowledge of the ongoing case, the petitioner went abroad on 21.06.2022. In these circumstances, the present petition is dismissed. However, the petitioner is directed to appear before the learned trial Court and to move an appropriate application by raising all the pleas taken in this petition, before the trial Court regarding his nonappearance.
