The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to release final bills, security and bank guarantee.

On 04.12.2025, the following order was passed:- "
Counsel for the petitioner states that the bill for construction of Community Centre in village Hayatpur in Gurugram was cleared by respondent No.4 vide communication dated 28.02.2022, Annexure P-3. She asserts that despite representations, the payment has not been disbursed and that performance security as well as bank guarantee given to the respondents has also been withheld.
Advance copy of the petition has been served upon the respondents. State counsel requests for a short accommodation to get instructions about the timeline PARAMJIT KAUR SAINI 2026.03.16 04:42 I attest to the accuracy and integrity of this document
CWP No. 36194 of 2025 -2within which admitted payment shall be disbursed to the petitioner.

Learned State counsel, on instructions from Ms. Deepa, SDE, PWD (B&R) Branch, Gurugram, submits that admitted liability of Rs. 14,00,000/- is outstanding against the State and it would be discharged within four months from today. The petitioner may avail remedies as permissible by law if he feels that any other amount is due against the respondents.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with liberty to petitioner to avail remedies as permissible by law with respect to disputed liability, however, admitted liability shall be released within four months from today.
