Present petition has been filed under Section 482 of BNSS for grant of anticipatory bail to the petitioner in FIR No.219 dated 12.09.2025 under Sections 105 and 190 of Bharatiya Nyaya Sanhita 2023 registered at Police Station Sadar Dhuri, District Sangrur, Punjab. 2.
On 05.12.2025, following order had been passed: - "Prayer in the present petition filed under Section 482 of the BNSS, 2023 is for grant of anticipatory bail to the petitioner in case FIR No.219 dated 12.09.2025 registered under Sections 105 and 190 of the Bharatiya Nyaya Sanhita, 2023, at Police Station Sadar Dhuri, District Sangrur.
Brief facts as per the case of the prosecution are that the petitioner with a common objective pushed the father of the complainant, due to which he fell on the ground and later on died.
Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. He argued that the present FIR emanates out of civil dispute between
-2the parties and the name of the petitioner have been dragged up unnecessarily. He further argued that as per the prosecution, on 12.09.2025, various officials of the Revenue Department had reached the spot along with the complainant and others including Bhagwant Singh-deceased for executing the warrants of possession. It is further alleged by the prosecution that the petitioner along with other co-accused, namely, Gurmail Kaur, Amarjit Kaur, Jaswinder Kaur, Farman Singh and 3-4 unknown person came at the spot and started opposing the revenue authorities and snatched the pillars and boki. It is further alleged that during the scuffle, coaccused Gurmail Kaur pushed Bhagwant Singh (father of the complainant) who fell on the ground and later on died.
He argued that the entire occurrence was video-graphed in detail by the persons present at the spot and it is crystal clear that during the entire episode, Bhagwant Singh (deceased) was not even touched by the present petitioner. Furthermore, no fight or quarrel took place at the spot, which is clearly visible in the video and the deceased did not suffer a single injury prior to his fainting and falling on the ground and hence, the entire story put forth by the complainant is concocted one. He further submitted that the petitioner is a household lady and there is no chance of her fleeing from law. It has also been contended that if the contents of the FIR are taken to be true, even then no specific role has been attributed to the present petitioner. FSL is yet to give report on the exact cause of death.
Further, coaccused Gurmail Singh, Harjit Kaur and Paramjit Kaur have already been granted the concession of anticipatory bail by this Court, vide order dated 28.11.2025. Moreover, the petitioner has clean antecedents as she is not involved in any other case and no recovery is to be effected from her. Learned counsel has further submitted that the petitioner is ready and willing to join the investigation as and when called upon to do so by the investigating agency.

-3On asking of the Court, Mr. Ravinder Singh, DAG, Punjab, accepts notice on behalf of respondent-State and seeks time to file status report in the matter.
Adjourned to 22.12.2025.
In the meantime, the petitioner is directed to join investigation within a week from today and would appear as and when required by the Investigating Officer and cooperate with the Investigating Agency. In the event of arrest, he shall be admitted to interim bail on furnishing of bail/surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioner shall also abide by the conditions as envisaged under Section 482(2) of BNSS, 2023."

Learned counsel for the petitioner submits that in compliance of the order dated 05.12.2025 passed by this Court, the petitioner has joined the investigation.

Learned counsel for the State, on instructions from ASI Jasvir Singh, has submitted that the petitioner has joined the investigation and is no longer required for further investigation.

In view of the statement made by learned State counsel, the interim order dated 05.12.2025 is made absolute. The petitioner shall continue to join investigation, as and when called by the Investigating Officer and shall also abide by the conditions as provided under Section 482(2) of the BNSS.
