"#$ Bharatiya Nagrik Suraksha Sanhita, 2023 seeking anticipatory bail for the petitioner in FIR No.166 dated 28.10.2025 under Sections 137(2), 304(2), 351, 191(3) and 190 of BNS 2023 and Sections 25 and 27 of the Arms Act, 1959 registered at Police Station Bhargo Camp, Jalandhar, District Jalandhar. Case of the prosecution is that the petitioner had pointed a countrymade pistol on the head of the complainant and snatched a sum of Rs.27,000/- from his pocket. It is also stated that the petitioner alongwith his co-accused gave beatings also to the complainant.

Counsel for the petitioner submits that the version of the complainant is totally wrong. He further submits that infact the complainant party was the aggressor and they opened attack on the petitioner as well as his friend.

Notice of motion.

Mr. Rohit Hans, DAG, Punjab accepts notice on behalf of the State and submits that the allegations against the petitioner are very serious. He further contends that custodial interrogation of the petitioner would be necessary as the weapon used in the offence i.e. the country-made pistol is still to be recovered from or at the instance of the petitioner. Hence, he prays for dismissal of the application.

Heard.

In light of the above and keeping in view the serious allegations levelled against the petitioner as well as the specific stand taken by the State Counsel with regard to recovery of weapon of offence to be made from the petitioner, this Court does not find sufficient grounds to grant the concession of anticipatory bail to the petitioner at this stage. Dismissed.
