The present petition has been filed by the petitioner for grant of anticipatory bail in case arising out of DDR No.19, dated 26.10.2025, registered under Sections 118, 115(2), 324(4), 191(3) read with Section 190 of the BNS (offence under Section 118 of the BNS was deleted and Section 118(1) of the BNS was added lateron) recorded in cross case bearing FIR No.80, dated 25.10.2025, registered under Sections 326(f), 126(2), 324(4), 115(2), 351(2), 3(5) of the BNS, at Police Station Sadar Budhlada, District Mansa.

Vide order dated 08.12.2025, passed by this Court, the petitioner was granted interim bail and was directed to join investigation. 3.

CRM-M-68769-2025 (O&M) -2instructions from the Investigating Officer has submitted that the petitioner has joined investigation on 02.01.2026. He has also submitted that custodial interrogation of the petitioner is not required. 4.
This Court has heard the rival submissions made by learned counsel for the parties.

Given the nature of the allegations as levelled against the petitioner as well as the above discussed facts, this Court is of the considered opinion that no case for pre-trial incarceration of the petitioner is made out. Pre-trial incarceration even otherwise should not be a replica of post conviction sentencing. Taking into consideration the above discussed facts, this petition is allowed and the order dated 08.12.2025 granting interim bail to the petitioner is made absolute, subject to compliance of conditions laid down in Section 482(2) of BNSS.
