The prayer in the present petition under Section 528 of BNSS, 2023 is for quashing of the order dated 12.09.2025 (Annexure P-3) in case FIR No.118 dated 22.08.2021 under Sections 323, 341, 506, 34 IPC (Sections 308, 325 of IPC added later on) registered at Police Station Bareta, District Mansa.

On 10.12.2025, the following order was passed:- "Learned counsel for the petitioner inter alia contends that the petitioner could not appear before the Trial Court on 12.09.2025 since he had been arrested in another FIR. He further contends that the absence of the petitioner was neither intentional nor willful but on account of circumstances as aforesaid. He further submits that the petitioner shall appear before the Trial Court by the next date fixed i.e. 23.12.2025.

Notice of motion.

In the meanwhile, in the event of the petitioner appearing before the Trial Court on or by 23.12.2025 and subject to deposit of costs of Rs.2,500/- with the District Legal Services Authority, Mansa, he be admitted to interim bail by the Trial Court on his furnishing of bail/surety bonds to its satisfaction."

Despite passing of the aforementioned order, the petitioner has not surrendered before the Trial Court.

In view of the above, the present petition stands dismissed. 5.

All the pending miscellaneous applications, if any, stand disposed of.
