The petitioner who is confined in District Jail, Gurugram, with regard to commission of offence punishable under Sections 318(4), 61(2) and 238(C) of the Bharatiya Nyaya Sanhita, 2023, hereinafter being referred to as "BNS" only, arising out of FIR No. 160 dated 18.06.2025, Police Station Cyber Crime Central, Faridabad, District Faridabad, Haryana, has approached this Court for interim bail.

It has been alleged by the petitioner that with regard to above mentioned offences, he was arrested on 09.09.2025 and that presently he is lodged in District Jail Gurugram. According to petitioner, his old aged father is suffering from Nephrolithiasis and for that purpose, he has to undergo surgery. In support of above mentioned plea the medical record of his father has been annexed by the petitioner as Annexure P2. Criminal Misc. No. M-68729 of 2025 alleged that the petitioner is the only son, and that there is none else in family to look after his father at the time of surgery. Hence, the request for his release on interim bail.

Since advance notice has already been served upon the State, Mr. Parveen Kumar Aggarwal, Additional Advocate General, Haryana,, accepts notice on behalf of respondent, and waives service. The learned State counsel has not opted to file any reply but orally opposed the present petition.

A careful perusal of the medical record of the petitioner's father shows that his father has to undergo surgery at the earliest, and that in his absence, there is no one in the family to look after his ailing father at the time of surgery.

In view of above mentioned peculiar facts & circumstances, it is hereby held that the present petition deserves to be allowed. Hence, the same is hereby allowed and the petitioner is admitted to interim bail for a period with effect from the date of furnishing bonds till 15.12.2025, subject to the condition of his furnishing bail bonds to the satisfaction of learned trial Court/Duty Magistrate. The petitioner shall surrender before the jail authorities by 05:00 P.M. on 15.12.2025.
