Present petition has been filed by the petitioner, seeking grant of anticipatory bail, in case, FIR No.172, dated 06.10.2025, under Sections 115(2)/118(1)/118(2)/191(3)/190 of BNS, registered at Police Station Ghuman, Batala, District Gurdaspur.

As per the allegations in the FIR, a physical altercation took place between the petitioner's sister namely Rajbir Kaur, and her husband namely Harpinder Singh (victim/injured in the present case). Provoked by the dispute, petitioner allegedly became enraged and struck his brother-in-law Harpinder Singh, on the head with a dattar, resulting in grievous injury.

On hearing the submissions addressed by counsel for the petitioner, on 08.12.2025, following order was passed:- ii.
Two sides of a dispute involving a physical altercation emerged due to matrimonial discord
between Harpinder Singh s/o Jarnail Singh and Rajbir Kaur.
Their marriage was solemnized on 29.01.2024, and immediately thereafter disputes arose between the husband and wife as well as among other family members of both sides.
On 25.11.2025, the dispute was resolved through the intervention of certain respectable persons in society. In order to ensure a smooth future life, Harpinder Singh (husband of Rajbir Kaur) accepted all responsibilities, including maintaining his wife by depositing an amount of Rs.2,00,000 in her account and agreeing to pay Rs.5,000 per month towards her expenses.
However, on 26.09.2025, another dispute arose, resulting in a physical altercation. Rajbir Kaur, by making a phone call, summoned her family members from her parental house, leading to the incident of the fight at her matrimonial home. In that incident, the petitioner allegedly inflicted a datar blow on the left side of Harpinder Singh's head, which was subsequently opined to be a grievous injury in the left parietal region.
iii) Learned counsel for the petitioner contends that there was no such intention on the part of the petitioner and that the injury attributed to him has been falsely planted.
iv) Since the dispute arises out of matrimonial disharmony between the parties, the Court would first like to hear the other side as well, to ascertain whether they are willing to resolve the dispute before the matter is examined on merits in accordance with law. On the oral request of learned counsel for the petitioner, complainant Harpinder Singh s/o Jarnail Singh, resident of Ghuman, Batala, Punjab, is hereby impleaded as party-respondent No.2.
Let the amended memo of parties be filed in the Registry within two days from today without filing any separate application.

Notice of motion for 15.01.2026.
On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab puts in appearance on behalf of the respondent - State. He seeks some time to file reply. 6.
Till the next date of hearing, arrest of petitioner shall remain stayed.

Complainant Harpinder Singh, Rajbir Kaur, and their other family members, if they so choose, may appear before this Court on the next date of hearing to explore the possibility of resolving the dispute. 8.

On the very outset, learned counsel for the petitioner submits that talks of compromise are underway between the parties; therefore, he seeks permission to withdraw the present petition, with liberty to file a fresh petition once the dispute is amicably resolved among the family members for all purposes.
