Learned counsel appearing on behalf of the petitioner contends that the aforesaid FIR was registered against Sukhwinder @ Sukha and Sukhwinder Singh @ Babbu as 513 grams of heroin was recovered from their possession. Counsel contends that the petitioner was nominated as an accused on the basis of disclosure statement made by Sukhwinder @ Sukha. The said co-accused disclosed that the contraband was secured from the petitioner.
He contends that the petitioner is in custody since 02.07.2025 and that no recovery has been effected from his possession after his arrest and during investigation. The case is still at initial stage of trial and no witness, out of 19 witnesses cited by the prosecution, has been examined so far. He thus submits that conclusion of trial shall take long. He further contends that a co-accused nominated on the basis of disclosure statement was granted regular bail by a Coordinate Bench of this Court vide order dated 17.09.2025 passed in CRM-M-51205-2025 titled as Nachhattar Singh Vs. State of Punjab, after three months of custody.

State of Punjab granting regular bail to the petitioner therein is concerned, there is nothing on record to suggest that the petitioner therein had criminal antecedents and/or was involved in other cases under the NDPS Act. Hence, principles of parity do not get applied.
