***** ARCHANA PURI, J. (Oral) Both the applicant as well as respondent, are present before the court today.
After having interaction with them, who both are Advocates, they submit that they are very clear to seek divorce by mutual consent. However, the applicant submits that she is ready qua the same, only if the loan, amounting to Rs.10,00,000/- which was availed in her name, from Punjab and Sindh Bank, Gohana branch, by the respondent side, is cleared by the respondent. Respondent also gives an undertaking to clear the entire outstanding amount of loan, taken and he also gives an undertaking to prove the particulars of the loan and the outstanding amount, before recording of statements of first motion.
In the light of the amicable settlement, so reached, between the parties, for filing of petition under Section 13-B of Hindu Marriage Act, the
respondent submits that he shall withdraw the petition under Section 13 (1) (i) (i-a) of Hindu Marriage Act, titled 'Ankit Chahal v/s Maina', i.e. DMC/91/2024, pending before the courts at Gohana, by way of filing of an application, within a period of ten days from today onwards, as the date fixed in the said case is 21.04.2026. On filing of such application, the court concerned shall pass an appropriate order, with regard to the withdrawal of the petition under Section 13 of Hindu Marriage Act. In the light of the undertaking given by the respondent, even the applicant has given an undertaking that she shall withdraw all the litigation arising, on account of the broken marriage.
Also, both the applicant as well as respondent have given an undertaking that they shall file the petition under Section 13-B of Hindu Marriage Act, after the withdrawal of the petition under Section 13 of Hindu Marriage Act, within a period of fifteen days from today onwards. After filing of an application, at the time of recording of statements of first motion, the detail of the other pending litigation and the undertaking given for withdrawal of the other litigation made by the applicant today, shall be mentioned in the petition, as well as in the statement of first motion and the necessary compliance, relating to the same shall be made, within a period of three months thereafter and before recording of the statement of second motion.
Likewise, in view of the undertaking, so given by the respondent, he shall give the particulars of loan, so availed in the name of the applicant, mention whereof shall be made in the petition under Section 13-B of Hindu Marriage Act and also in the statement of first motion. The
respondent also gives an undertaking to clear the said loan, within a period of three months from the date of recording of statement of first motion. In view of the terms, so settled, the applicant as well as the counsel make a statement that they do not want to pursue with the present application and the same be dismissed as withdrawn. Ordered accordingly.
Both the parties shall remain bound by the undertakings, so given by them today before the court.
