(Oral) The present third petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the petitioner in case bearing FIR No.78 dated 18.06.2024 registered under Sections 18 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Lalru, District Mohali. 2.
The matter has already been taken up on 04 occasions, however, on two of the said occasions, none appeared on behalf of the petitioner while on the remaining two, adjournment requests were made by counsel for the petitioner. Today also, the case has been called twice, however, no one has chosen to appear on behalf of the petitioner. Hence, the present case is being examined on merits in the absence of counsel. 3.
As per the case set up by the prosecution, on 18.06.2024, SI Baljinder Kaur alongwith other police officials were present at Lehli T-Point in connection with special nakabandi. At about 1.45 PM, one car bearing registration no. PB-07-BA-5451 make XUV colour grey, in which two persons were traveling, was seen coming from Ambala side towards Zirakpur and on suspicion, it was stopped by ASI Rajinder Singh. CRM-M-69392-2025(O&M) kg opium was recovered from beneath the conductor seat of the said car. The driver of the said car disclosed his name as Deepak @ Jatt and the person sitting on the conductor seat disclosed his name as Vijay Kumar. They were apprehended and arrested in the case.

A recovery of 04 kgs of opium has been effected from the car which is registered in the name of father of the petitioner herein and the petitioner was driving the said vehicle while co-accused Vijay Kumar was sitting besides him. While the petitioner herein avers in the petition that the 04 kgs of opium was lying under the seat of the co-passenger and that he was not aware, however, there is nothing on record on the basis whereof the said version can be accepted at this stage. The plea being sought to be set up by the petitioner at this stage is a matter of defence required to be established by the petitioner at the stage of trial. The recovered contraband is 04kgs of opium which is a commercial quantity and the petitioner also has one other case under the Narcotic Drugs and Psychotropic Substances Act, 1985. 5.
Further, it has also been apprised to this Court that 13 witnesses have been cited by the prosecution out of which 6 stands examined and only 07 remain to be examined. The case is now fixed before the Trial Court for 22.04.2026 for examination of the prosecution witnesses. 6.
Finding no merits, the present petition is dismissed, at this stage. 7.
