Prayer in this writ petition filed under Article 226 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to (i) pay interest as per the provisions of General Provident Fund Rules on delayed depost of provident fund from the date the said amount was deducted every month from the salary till its actual deposit by Municipal Council, Ferozepur City (ii) pay the remaining retiral benefits of Gratuity, Leave Encashment, Provident fund along with interest as aforesaid, medical allowance and all other benefits (iii) pay interest @ 12% from the date of death till the date of its actual payment to the petitioner.

On 08.12.2025, the following order was passed by this Court:- Learned counsel for the petitioner(s) submits that the retiral benefits of the petitioner have been withheld by the respondents without any justifiable cause. He further contends that despite serving the legal notice dated 28.10.2025 (Annexure P-2 in CWP-36611-2025) and legal notice dated 06.11.2025 (Annexure P-2 in CWP-366832025), the grievance of the petitioner(s), have not been redressed. At the time of the retirement of the petitioner(s), neither any departmental proceedings nor judicial proceedings were pending. As such, withholding the retiral dues of the petitioner(s) is contrary to settled law. Learned State counsel seeks a short accommodation to address arguments.

Learned counsel for respondent No.3, submits that some of the retiral dues of the petitioner have been released and the remaining retiral duesd would be released to the petitioner within a period of 03 months from today.

In reply, learned counsel for the petitioner submits that he would be satisfied at this stage, if the present petition is disposed of in terms of the statement made by learned counsel for respondent No.3. 5.

In view of the above and in the wake of the statement made by learned counsel for respondent No.3, the present petition is disposed of with a direction to respondent No.3 to release the remaining
