Present petition has been filed by the petitioner under Section 528 of BNSS Act, for issuance of a direction to respondent No.1 to 4 to hand over the enquiry/investigation in FIR No.85 dated 05.06.2024, registered under Sections 406, 420, 120-B of IPC at Police Station Division No.5, Police Commissionerate Ludhiana to some independent agency. 2.
Learned counsel for the petitioner contended that bail petition i.e. CRM-M-43453-2024 of respondent No.7-Manish Aggi has been dismissed by the Hon'ble High Court vide order dated 24.09.2024 (Annexure P-2) and he has challenged the aforesaid order before Hon'ble Supreme Court, wherein also SLP (Crl.) No.18762-2025 has been dismissed vide order dated 26.11.2025 (Annexure P-3); and two months have been passed, but no action has been taken against respondent No.7. Thus, learned counsel prayed for a direction to hand over investigation to some independent agency. Mr. Anup Singh, AAG, Punjab, upon advance notice, puts in appearance on behalf of respondent-State and submitted that non-bailable warrants have been issued against respondent No.7 - Manish Aggi for 19.02.2026; challan against one co-accused has already been presented after completion of investigation; investigating agency will make sincere efforts to arrest him and to complete the investigation expeditiously. 5.

Keeping in view the submission made by learned State counsel that non-bailable warrants against respondent No.7 have already been issued, the present petition is disposed of.
