The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondent to release salary for the month of April' 2025 as well quash remarks in retirement order. 2.

The petitioner was appointed as Cook (Class-IV) on 14.06.1996 on regular basis. He was posted as Havaldar Clerk with Home Guard Ambala vide order dated 09.04.2025. He was ordered to hand over charge vide order dated 23.04.2025. He retired on 30.04.2025 from the post of Havaldar Clerk. Respondent department did not release his dues on the ground that he did not hand over charge. He was directed to hand over charge vide letter dated 06.08.2025 for release of retiral dues. Learned counsel for the petitioner submits that petitioner's salary for the month of April' 2025 was not released. Neither charge sheet was issued nor departmental proceeding was pending at the time of his superannuation. He was present from 23.04.2025 to 30.04.2025 to hand over charge but no action was taken by officer concerned. Inclusion of the remarks 'under charge' in the retirement order was unwarranted. 4.

Learned State counsel submits that as per his instructions, all retiral dues except leave encashment and arrears of pension stand released. Leave encashment and arrears of pension would be processed within two months from today. The Competent Authority would release leave encashment and arrears of pension subject to outstanding dues against the petitioner within three months from today.

In the wake of statement of learned State counsel, the petition stands disposed of.
