Present petition has been filed by the petitioner, seeking grant of regular bail, in case, FIR No.106, dated 24.04.2025, under Section 21 of NDPS Act, registered at Police Station Anti Narcotics Force (ANTF) Wingh, District SAS Nagar.

As per case of the prosecution, while police party was on patrol duty, a secret informer informed them that accused, namely Sahil Kumar and Krishan Singh (petitioner herein), were involved in the illegal trade of heroin and were presently standing on the opposite side of the road in front of the Indian Oil Petrol Pump on the Fazilka-Jalalabad Road, on their motorcycle bearing registration No.PB-22X-4066, while waiting for customers.

CRM-M-69858-2025 -2from their joint possession, which was kept in a polythene bag placed on the seat of the motorcycle.

Quantity of the recovered contraband is twice the maximum limit prescribed for non-commercial quantity. As of now, petitioner has undergone incarceration only for a period of one year and 15 days. Therefore, this Court does not find any ground to extend the concession of regular bail to the petitioner in the present case, at this stage. 5.
