Petitioner - Amritpal Singh Gill, aged about 52 years, has filed instant petition for seeking anticipatory bail in case FIR No. 230, dated 22.11.2025 registered under Sections 115(2), 118(1), 109 of BNS, 2023 at Police Station Civil Lines Patiala, District Patiala. 2.
Learned counsel for the petitioner inter alia contends that present dispute has, in fact, arisen out of a matrimonial discord between the partis, as daughter of the petitioner, namely, Maple Gill, is married to Tegveer Singh @ teji, who is son of Satvir Inder Singh (complainant in the present case).
3.
As per FIR, accused persons came to the house of the complainant and caused injuries to the complainant and his family members. Specific allegation against the petitioner is that he gave the sword blow on the left side of the stomach of the complainant and also gave beatings to the son of the complainant, who is also petitioner's son-in-law.
All the injuries suffered by the complainant/victim's party have been opined as simple in nature.
4.
Learned counsel for the petitioner argues that petitioner, his wife and daughter were subjected to physical and mental torture by the complainant party. Complainant party also caused four injuries upon the petitioner as per MLR dated 22.11.2025. Besides, a cross-case, i.e., vide GD No.46, dated 22.11.2025 (P-2) has also been got registered at the instance of petitioner's daughter on the same date against the complainant party.
- 3 - It is further submitted that petitioner is ready to join the investigation and fully cooperate with the investigating agency, provided he is granted protection from arrest by this Court. Thus, counsel prays for grant of anticipatory bail to the petitioner in the present case.
4.
Notice of motion.
On advance notice, learned State counsel puts in appearance and accepts notice on behalf of the respondent - State. Mr. Tanvir Singh Grewal, Advocate puts in appearance on behalf of the complainant and filed his Power of Attorney. Since other petition filed by the co-accused-Gurkamal Kaur i.e. CRM-M-69677-2025 is fixed for 23.02.2026, let the present case be also listed for hearing on 23.02.2026. To be heard alongwith CRM-M-69677-2025.
9.
In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).
10.
Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.
It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court." 3.
Learned counsel for the petitioner(s) further contend that in compliance of the orders dated 11.12.2025 and 19.01.2026, respectively, passed by this Court, the petitioner(s) have already joined the investigation and are ready to co-operate with investigation agency, as and when same is required again.
Thus, custodial interrogation of the petitioner(s) would not serve any purpose to the prosecution and therefore, seeks confirmation of the interim bails.
4.
Learned State counsel on instructions, submits that though investigation has been joined by the petitioner(s), but petitioner - Amritpal Singh Gill (in CRM-M-2566-2026) is not cooperating in effecting the recovery of weapon.
Upon this, learned counsel for the petitioner(s) submits that petitioner has been falsely implicated in the case, therefore, he cannot be pressurized to hand-over the weapon to the Investigating Officer. However, in compliance to this Court's order, petitioner - Amritpal Singh Gill, has already joined investigation.
- 4 - Heard learned counsel for the parties.
Since, petitioners have already joined the investigation and custodial interrogations are no more required; ad-interim bail orders dated 11.12.2025 and 19.01.2026, respectively, passed by this Court are hereby made absolute. Accordingly, present petitions are allowed. However, petitioners shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. Accordingly, petition stands disposed of.
However, present order would be subject to the submission of passport of the petitioners to the Investigating Agency or to Court concerned, if they possesses, within a period of one week from today. Otherwise, they would submit an affidavit, disclosing the fact that they do not possess any passport.
It is clarified that in case, aforesaid condition is not complied with, this order would be considered as non est automatically. Pending misc. application(s), if any, also stand(s) disposed of.
Photocopy of this order be placed on the files of other connected case.
