Prayer made in the present petition is for quashing of FIR No.890 dated 22.12.2022, registered under Section 174-A IPC at Police Station Kundli, District Sonipat.

Learned counsel submits that the petitioner was not named in the FIR. His name surfaced based on the disclosure statement of co-accused while in custody. Warrants of arrest issued against him were not received back served or otherwise, however, he was declared proclaimed person vide order dated 20.04.2018 without mandatory period of 30 days having been elapsed, as the case was adjourned merely for completion of the said period. Be that as it may, Co-ordinate Bench of this Court vide order dated 25.04.2025 passed in CRMM-21115-2025, directed the petitioner to join proceedings by releasing him on interim bail, which was later confirmed after he joined.

Learned State counsel submits that the FIR was rightly registered as the petitioner was declared proclaimed person by the trial Court for having absented.

The petitioner having joined the proceedings subsequent to his being declared proclaimed person and the Court having extended him the concession of regular bail, are factored to conclude that the very purpose of initiation of proclamation proceedings, that was to compel and secure his presence to face the trial and establish the rule of law, so as to ensure finalization of the proceedings, stood nonetheless achieved. Hence this Court finding that continuation with the proceedings in question would amount to an abuse of the process of the Court, thus, the FIR is liable to be quashed, in exercise of power under Section 482 CrPC.

In view of the foregoing, the present petition is allowed and FIR No.890 dated 22.12.2022, registered under Section 174-A IPC at Police Station Kundli, District Sonipat! .
