(Oral) The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 challenging the order dated 18.01.2025 passed by the Judicial Magistrate First Class, Sangrur vide which the petitioner had been declared as a proclaimed person in Complaint Case No.1171 of 2022 filed under Section 138 of the Negotiable Instruments Act, 1881.

On 12.12.2025, the following order was passed "Challenge in the present petition is to the order dated 18.01.2025 passed by the Judicial Magistrate 1st Class, Sangrur in complaint case bearing No.1171 of 2022 under Section 138 of the Negotiable Instruments Act, 1881, whereby the petitioner has been declared as a proclaimed person. Learned counsel appearing on behalf of the petitioner contends that the petitioner had appeared before the trial Court on 13.05.2024 and had been admitted to bail on the Court noticing that there are chances of compromise. She contends that the petitioner also deposited a sum of Rs.40,000/- via google pay and was required to arrange for the remaining payment. He, however, could not arrange the same, hence, under the apprehension that he would be arrested, he did not appear in the Court on account of a wrong advice. CRM-M-70036-2025(O&M) that vide order dated 09.07.2024, - petitioner's salary was ordered to be attached and non-bailable warrants were issued. Vide order dated 18.01.2025, petitioner was declared as a proclaimed person. She submits that the petitioner shall appear before the trial Court within a period of two weeks from today. Notice of motion.
On the asking of this Court, Mr. Rituraj Singh, DAG Punjab, accepts notice on behalf of the respondent-State and prays for some time to file the reply.
List on 27.2.2026.
In the event of the petitioner appearing before the trial Court within a period of two weeks as undertaken today, subject to payment of a cost of Rs.5,000/- to the complainant, he shall be admitted to interim bail on his furnishing of fresh bail/surety bonds to the satisfaction of the trial Court. In such an eventuality, the operation of the order dated 18.01.2025 passed by the Judicial Magistrate 1st Class, Sangrur, declaring the petitioner as a proclaimed person shall remain stayed till the next date of hearing".

Learned counsel appearing on behalf of the petitioner fairly submits at the outset that the petitioner has not complied with the aforesaid order. She thus prays for withdrawal of the present petition. 4.
In view of the above, the present petition is disposed of as withdrawn.
