(Oral) At this stage, in view of the order passed on the last date of hearing, counsel for the petitioner submits that so far as the calculation qua arrears of amount, in consonance with the work-on, as per compliance of the order passed in CWP-8891-2003 i.e. Annexure P-1, is concerned, the same has been correctly made by the respondents.

However, the counsel for the petitioner, at this stage, submits that since the regularization of the service of the petitioner, relates back to the year 2001, the respondents are also required to create EPF account of the petitioner and also to make contribution in the same. COCP-6125-2025 However, the State Counsel submits that no amount, as such, has been deducted, for depositing the same in the EPF account. In the light of the same, the Department to look into it and ensure about start of the process for opening of the EPF account (if entitled), within a period of two weeks, from today onwards and also, to call upon the petitioner, to pay the amount to be deposited in the EPF account, as per the deduction, as worked upon by the Department and the requisite process shall be conducted by the Department, for necessary deposit of the same. The entire process shall be conducted within a period of four months, from today onwards.

In view of the aforesaid, counsel for the petitioner submits that he does not want to pursue with the present petition and the same be dismissed as withdrawn.

Ordered accordingly.

However, the parties shall remain bound by the aforesaid observations.
