Learned State counsel submits that the petitioner is in custody only for 3 months and 24 days and he was apprehended at the spot alongwith his co-accused, from whom commercial quantity of contraband has been recovered and was named in the secret information, in view of which, learned counsel for the petitioner prays for withdrawal of the present petition, at this stage.
