Present petition has been filed by the petitioner, seeking grant of regular bail, in case, FIR No.103, dated 02.07.2025, under Sections 115, 118(1), 126, 191(2), 191(3), 287, 351(3) of BNS and section 25(1)(a) of Arms Act (later on during investigation, offences under sections 118(2) and 117(2) of BNS were added, offence punishable under section 117(3) of BNS proposed to be added by submitting supplementary challan), registered at Police Station Nagina, District Nuh. 2.

Learned counsel for the petitioner submits that total 41 accused persons were named in the FIR along with 10-15 unknown persons. After investigation, only 14 accused were challaned, whereas 39 persons were found innocent and thus, exonerated. It is an admitted position that petitioner allegedly inflicted a knife blow upon the injured, namely Afzal, who is yet to appear in the witness box to depose in the present case.

In view of the statement made by learned counsel for the petitioner, present petition is dismissed, with liberty to file a fresh petition after the examination of the injured Afzal before the trial Court.
