Petitioner has filed petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail in FIR No.983, dated 14.06.2023, under Sections 120-B, 302, 323, 354-D, 201 and 34 of IPC (Sections 148, 149 and 308 of IPC deleted later on), registered at Police Station Karnal Civil Lines, District Karnal. 2.

As per facts of the case, complainant Krishna Devi gave her statement that she is mother of a son Narender and a daughter. The elder son is aged about 18 years who is student of first year in Dyal Singh College. On 13.06.2023 at about 10:00 am, he had come to Karnal for some work and was roaming with his friends in Karan Park, Karnal. When the complainant called on the mobile phone of her son and his friend. Rinku disclosed that Narender had a fight with some boys in Karan Park, Karnal in which he was seriously injured. Narender was admitted to KCGMC, Karnal. About 8-10 boys were involved in the said fight.

-2Thereafter, his son was referred from Kalpana Chawla, Hospital. Rinku and his other friends admitted her son to Dua Hospital, Karnal. When she reached the hospital her son was lying unconscious. With these allegations, FIR was registered under Sections 148, 149, 308 and 323 IPC. On 15.06.2023 Narender succumbed to the injuries and the offence under Section 302 IPC was added.

Learned counsel representing petitioner denied the allegations and alleged false implication in this case. Petitioner is behind the bars since 22.08.2023. In-fact, main allegations are against accused Ravi who allegedly inflicted injuries on the person of deceased. Disclosure statement of Ravi accused is Annexure P-3. Testimony of alleged eye witness Nishan Singh is untrustworthy. On the statement of victim girl 'N' recorded under Section 164 Cr.P.C. (Annexure P-4) said Nishant Sandhu was also arrayed as co-accused. Prosecution has tried to give improved version. Petitioner cannot be kept behind the bars for indefinite time period. Trial in this case may take long time. Therefore, petitioner may be released on regular bail. 4.

Bail petition is opposed by learned counsel representing State of Haryana assisted by learned counsel representing the complainant. In the case in hand, victim Narender was beaten up on 13.06.2023 who finally succumbed to the injuries on 15.06.2023. Investigation was completed. During investigation statement of victim victim girl 'N' was recorded on 09.10.2023 who named Nishant Sandhu as one of the person who used to harass her. Thereafter, Nishant Sandhu @ Nishu was also arrayed as coaccused for the offence under Section 354-D IPC. Challan is presented qua accused Vishal, Ravi and petitioner Amandeep on 13.10.2023. Charges

-3were framed vide order dated 22.11.2023 and out of total 33 prosecution witnesses, two witnesses have been examined i.e. Krishna Devi mother of the deceased and Doctor Rakesh Dua. Other witnesses are yet to be examined. It is further pointed out that present petitioner is involved in another FIR No.1069 dated 20.11.2022 under Sections 307, 323, 324, 325, 34, 379-B, 427, 452 and 506 of IPC registered at Police Station Karnal. Bail application filed by petitioner is opposed. 5.

I have considered the arguments. Petitioner is facing trial along with co-accused Ravi and Vishal. As per facts, petitioner and Vishal caught hold of arms of victim and Ravi inflicted injuries with danda. The said injuries lead to his death on 15.06.2023. His post-mortem report is Annexure R-1. Occurrence took place in the karan park in broad daylight. Present petitioner is specifically named along with other co-accused. Their disclosure statements are annexed with status report. No doubt trial is going at slow pace but at the same time specific allegations and the gravity of offence cannot be ignored.

Therefore, considering the aforesaid factual position, I am not inclined to grant regular bail to the petitioner and the same is declined. However, petitioner is behind the bars since 22.08.2023 therefore, trial Court is directed to expedite the trial.
