Present petition has been filed under Section 528 of BNSS, 2023, for quashing of FIR No.54 dated 17.04.2015 under Sections 353, 186, 332, 379, 120-B, 148 and 149 of IPC, registered at Police Station Lambi, District Sri Muktsar Sahib (Annexure P-1), challan dated 18.07.2020 (Annexure P-6) as well as Impugned Cognizance order dated 01.10.2020 (Annexure P-7) passed by court of learned Sub Divisional Judicial Magistrate, Malout, District Sri Muktsar Sahib. 2.

Learned counsel for the petitioner seeks to withdraw the present petition and has limited his prayer to the extent that, since the matter has not proceeded and the challan was filed in the year 2020, and till date charges have not yet been framed owing to the fact that there are 40 accused and one or two accused remain absent during the trial. It is further submitted that the petitioner is a Government teacher and is required to attend his official duties; therefore, his application for exemption from personal appearance may be considered sympathetically in accordance with law. Learned State counsel submits that he has no objection if the prayer made by learned counsel for the petitioner is accepted. 4.

Keeping in view the limited prayer of the petitioner seeking exemption from personal appearance before the trial Court, the present petition is disposed of with liberty to the petitioner to move an appropriate application before the trial Court. The trial Court shall decide the said application in accordance with law, and the plea of alibi, if any, shall be taken at the appropriate stage.
