The petitioner-in-person, who is the sole proprietor of petitioner No. 2, proprietorship firm, is assailing the order dated 26.11.2025 (Annexure P-6) passed by the Debts Recovery Tribunal-II, Chandigarh (hereinafter referred to as "DRT-II, Chandigarh"), whereby S.A. No. 695 of 2025 was disposed of on the basis of a statement allegedly made by the counsel for the petitioner that the petitioner was ready and willing to deposit a sum of Rs.10 lacs by 10:00 A.M. on 27.11.2025 and to pay the remaining amount in monthly instalments. Pertinently, as per the impugned order, the outstanding loan amount was approximately Rs.55 lacs.

The petitioner-in-person submits that no such instructions were given to the counsel to make a statement consenting to the deposit of Rs.10 lacs or to payment of the remaining amount in monthly instalments. 3.

Be that as it may, this Court is not inclined to entertain the present petition in view of the existence of an alternative statutory remedy, either by approaching DRT-II, Chandigarh for recalling of order dated 26.11.2025 passed KAMAL GANDHI 2025.12.19 15:33 I attest to the accuracy and integrity of this document

CWP-37388 of 2025 in S.A. No. 695 of 2025, or by approaching the Debts Recovery Appellate Tribunal (hereinafter referred to as "DRAT"), as the case may be. 4.

The petitioner is granted liberty to avail of either of the aforesaid remedies.

With the aforesaid liberty, present petition is disposed of without commenting upon the merits of the case.
