  Learned State counsel submits that the petitioner is in custody only for 4 months and 8 days and commercial quantity of contraband, it being 350 kgs of Poppy Husk has been recovered from the Scorpio, which is owned by the petitioner, in view of which, learned counsel for the petitioner prays for withdrawal of the present petition, at this stage. 2.
