Prayer in the instant petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is for seeking directions to respondents No.1 to 4 to conduct a free and fair re-investigation in case FIR No.15 dated 04.03.2019, registered under Section 21 of the Narcotic Drugs & Psychotropic Substances Act, 1985, at Police Station Maqsudan, District Jalandhar Rural.

  

  

       

    

  

    

      

 

      



  

 

  

The petitioner has also filed a representation to SSP, Jalandhar (Rural) on which, co-ordinate bench of this Court vide order

CRM-M-70860-2025 2 dated 10.09.2025, issued directions to respondent No.4-The Senior Superintendent of Police, District Jalandhar (Rural) to look into the representation and dispose of the same in accordance with law. However, respondent No.4 did not comply with the said order dated 10.09.2025, passed by the Coordinate Bench. Hence, the petitioner prays that the official respondents be directed to re-investigate the matter in the FIR in question. 3.

Learned State Counsel submits that the investigation in this case is complete and the case is already fixed for prosecution evidence. He further submits that there is no specific ground made by the petitioner in the petition which warrants reinvestigation. Therefore, learned State counsel prays for dismissal of the present petition.
