This order shall dispose of two petitions bearing CRM-M-713782025 and CRM-M-73723-2025 as these are arising out of same FIR. For brevity, the facts are being taken from CRM-M-71378-2025. 2.
These petitions have been filed by the petitioners seeking regular bail under Section 483 of BNSS in case FIR No.468 dated 15.07.2025 under Sections 109(1), 111(4), 61(2), 238 of BNS and Section 25 of Arms Act registered at Police Station City Yamuna Nagar, District Yamuna Nagar. 3.
As per the case of the prosecution, two young boys came on a Splendor motorcycle. The pillion rider of the said motorcycle threw a paper
into the house of the complainant and fired two rounds at him with an intention to kill him. It is further alleged that the complainant saved himself with great difficulty, and one of the said shots hit the bonnet of the Swift Dzire car bearing registration No. HR-11-0098 belonging to the complainant and one empty shell, one misfired round, a message written by a pen on a paper slip which read as " one paper slip written with pen as "Kalarana Group Romibhai Encounter Noni Rana" were taken into police possession. 4.
Learned counsel for the petitioners submits that the FIR was registered against unknown persons and the petitioners were not named therein. It is further submitted that on the same date, another FIR No. 193 was registered, in which both the petitioners were arrested. A mobile phone was allegedly recovered in the said case, and on the basis of their own disclosure statements, they have been nominated in the present case. 5.
Learned State counsel has vehemently opposed the prayer made by learned counsel for the petitioners. He has filed the reply by way of affidavit of Kanwaljeet Singh, HPS, Deputy Supdt. Of Police (HQ) Yamuna Nagar and custody certificates of the petitioners have been filed in Court today and the same are taken on record. As per the custody certificates, the petitioners ae in custody for more than 06 months and 21 days and there is no other case pending against the petitioners.

I have heard the submissions made by the parties and gone through the record.

After hearing the rival contentions of learned counsel for the parties and keeping in view the facts and circumstances of the case, particularly that apart from their own disclosure statements made in another FIR, there is no corroborative evidence against the petitioners; they have already been released on bail in that case; the petitioners are in custody for more than 6 months and 21 days; and that the trial is likely to take a considerable time to conclude, this Court is of the view that no useful purpose would be served by further incarceration of the petitioners. Accordingly, this Court deems it fit to grant the concession of regular bail to the petitioners during the pendency of the trial.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioners are ordered to be released on regular bail on their furnishing requisite bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. 9.
Nothing discussed hereinabove shall be construed as an expression of opinion on the merits of the case.

It is clarified that if while on bail so granted through the instant order, the petitioners are found indulging in any other criminal case/activity, it shall be open to the State to seek cancellation of their bail. 11.
Pending applications, if any, shall also stand disposed of. 09.04.2026.
