By this common order, all the three aforementioned petitions, i.e. CRM-M-70955-2025, CRM-M-71788-2025 and CRM-M4256-2026 shall stand disposed of. 2.

Petition i.e. CRM-M-70955-2025 has filed by the petitioner - Karamjit Kaur alias Kirna, seeking grant of anticipatory bail, in case, FIR No.0218, dated 01.08.2025, under Sections 105 and 127(6) of BNS, registered at Police Station Amargarh, District Malerkotla. Petitions i.e. CRM-M-71788-2025 and CRM-M-4256-2026 have filed by the petitioners - Akashdeep Kaur and Mohd Anwar alias Babbu, seeking grant of regular bail, in case, FIR No.0218, dated 01.08.2025, under Sections 105 and 127(6) of BNS, registered at Police Station Amargarh, District Malerkotla.

Learned counsel for the petitioners contend that, as per the allegations, complainant-Jagtar Singh, has lodged a complaint stating that on 26.07.2025, his son-Kulwinder Singh was taken from their house on a motorcycle by certain unknown persons. It is further alleged that on 27.07.2025, those unknown persons left Kulwinder Singh at Malerkotla Bypass, Dhuri, at about 4:00 P.M., whereafter the complainant admitted him to Civil Hospital, Dhuri for treatment.

On 29.07.2025, Kulwinder Singh reportedly told the complainant that he was not feeling well and requested to be taken home. Consequently, he was discharged from the hospital and taken to their residence at Sherpur Sodhian. Thereafter, on 01.08.2025, due to severe

pain, he was again taken to Civil Hospital, Dhuri, where the attending doctor declared him brought dead.

Learned counsel for the petitioners submit that, as per the medico-legal examination report dated 29.07.2025, no injury suggestive of manual assault was noticed by the doctors. All superficial abrasions were found only on the left side of the body. It is, thus, contended that the allegations have been levelled merely on suspicion and are based on a concocted version of events.

It is additionally submitted that the deceased was suffering from a chronic liver ailment and on several previous occasions, he had been admitted to the hospital for treatment.

Learned counsel further contend that nothing remains to be recovered from the possession of the petitioners. Thus, they jointly pray for grant of bail to all three petitioners in the present case. 5.

In response to the arguments addressed by learned counsel for the petitioners, learned State counsel, produces the custody certificates dated 09.02.2026 in Court today, which are taken on record. Office to tag the same at appropriate place. A copy thereof has been handed over to the counsel for the petitioner. As per the custody certificates, in the present case, both the petitioners - Mohd. Anwar alias Babbu and Akashdeep Kaur have already undergone 04 months and 18 days period inside jail. 6.

Learned State counsel has also filed status report dated 23.02.2026 in the Court today and the same is taken on record.

Learned State counsel, while opposing the prayer and submissions made on behalf of the petitioners, submits that injuries were duly noticed in the medico-legal examination and, therefore, the allegations appear to be in consonance with the medical record. On that basis, it is contended that petitioners do not deserve the concession of bail.

On being asked by this Court, learned State counsel submits that investigation qua petitioners - Mohd. Anwar @ Babbu and Akashdeep Kaur stands concluded, as challan has already been presented on 11.12.2025 and charges have been framed on 06.02.2026 against them.

It is further submitted that in compliance with the direction issued by this Court, vide order dated 12.01.2026, petitioner - Karamjit Kaur @ Kirna has joined the investigation, and supplementary challan qua her shall also be filed in due course.

This Court has heard the submissions advanced by learned counsel for the parties and has perused the record made available, including the details of injuries allegedly suffered by the deceasedKulwinder Singh. 10.

Injuries as described in the medico-legal examination report (MLR) dated 27.07.2025 are reproduced here under:- Sr.

At this stage, no opinion is required to be expressed with regard to the exact nature of the injuries suffered by Kulwinder Singh (since deceased) or the manner in which the same might have been caused. It is, however, a matter of record that several of the injuries were not visible, and those that were visible, comprised abrasions on the left side of the body, i.e. on the left cheek, left arm, left zygomatic region, and left foot.

Whether the said injuries were inflicted manually, caused by some other means, or sustained while the deceased was lying on the ground in pain, is a matter to be determined upon appreciation of the complete evidence to be led before learned trial Court, including the medical evidence.

Accordingly, in view of the totality of the circumstances, nature of the allegations levelled against the petitioners, and the factors

noticed here above, this Court deems it appropriate to grant the concession of bail to the petitioners in the present case. Consequently, prayer made in the present petitions is allowed.

Petitioners namely Mohd Anwar alias Babbu (in CRM-M4256-2026) and Akashdeep Kaur (in CRM-M-71788-2025) are ordered to be released on bail, subject to their furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 14.

Needless to observe that the petitioners namely Mohd Anwar alias Babbu (in CRM-M-4256-2026) and Akashdeep Kaur (in CRM-M71788-2025) shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 15.

Any of the discussion done and recorded here above, shall not be construed as an expression of opinion on the facts of the case. Therefore, trial Court is expected to decide the case by taking an independent view, on the basis of evidence available on record, as expeditiously as possible, in accordance with law. 16.

As regards petitioner - Karamjit Kaur alias Kirna (in CRMM-70955-2025) is concerned, since she has already joined the investigation; ad-interim bail order dated 12.01.2026 (passed in CRM-M70955-2025) by this Court is hereby made absolute. Accordingly, present petition is allowed.

However, petitioner - Karamjit Kaur alias Kirna shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023.

It is clarified that present order qua petitioner - Karamjit Kaur alias Kirna would be subject to the submission of her passport to the Investigating Agency or to Court concerned, if she possesses, within a period of one week from today. Otherwise, she would submit an affidavit, disclosing the fact that she does not possess any passport. It is clarified that in case, aforesaid condition is not complied with, this order would be considered as non est automatically.

With the directions issued here above, all the three petitions, i.e. CRM-M-70955-2025, CRM-M-71788-2025 and CRM-M-4256-2026 stand disposed of.

A photocopy of this order be placed on the files of other connected cases.
