  2+0+( + )3     4 56Petitioner, who is accused in case FIR No.316 dated 27.11.2025 registered against her, for commission of offences punishable under Sections 21-B,61,85 of NDPS Act (Section 29 of NDPS Act added later on) at Police Station Dinanagar, District Gurdaspur, has filed the instant petition, praying for grant of pre-arrest bail.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case as his name was nominated on the basis of the disclosure statement of co-accused, who was allegedly caught red handed at the site keeping in his illegal possession 09 grams of heroin (Marginally higher than the small quantity). Learned counsel further contends that the said disclosure statement, in the absence of recovery of any other incriminating material, is not admissible in evidence. Learned counsel further submits that petitioner is willing to join the investigation as and when called for by the I.O. Notice of motion for 11.03.2026.

Meanwhile, without expressing any opinion on the merits of the case, the petitioners are hereby directed to join MOHIT 2026.03.12 12:02 I attest to the accuracy and integrity of this document

In the event of the arrest of the petitioners, they shall be released on interim bail on their furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer.
