(Oral) This first petition has been filed for grant of pre-arrest bail to the petitioner(s) in case bearing FIR No.89 dated 05.09.2024 registered under Section 420 of the Indian Penal Code, 1860 and Section 13 of the Punjab Travel Professionals (Regulation) Act, 2012 registered at Police Station Ramdas, Amritsar Rural, District Amritsar.

Learned counsel appearing on behalf of the petitioner contends that the matter has already been compromised between the parties and the issues arising thereof have been resolved.

Counsel for respondent No.2 contends that even though all other issues stand resolved, however, the cheque and passport have not been returned.

Responding to the above, counsel for the petitioner undertakes that the cheque and passport shall be handed over to the Investigating Agency within a period of two weeks from today.

In view of the above, the present petition is allowed. The petitioner is directed to appear before the Investigating Officer and submit the cheque in question as well as passport, whereupon the petitioner shall be released on anticipatory bail to the satisfaction of Investigating Officer/Arresting Officer, subject to the conditions as under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) of 2023. 7.

It is however made clear that the petitioner shall remain bound by the undertaking to submit the passport and the cheque to the Investigating Officer within a period of 02 weeks from today, failing which, the respondents shall be at liberty to move an application for seeking cancellation of the present bail.
