(Oral) The instant first petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the petitioner in case bearing FIR No.317 dated 14.11.2023 registered under Sections 302, 148, 149 (Section 120-B added later on) of the Indian Penal Code, 1860 and Sections 25 & 27 of the Arms Act, 1959 at Police Station Rama Mandi, District Jalandhar.

Briefly summarized, the facts of the case are that on 16.07.2021 at around 05:30 P.M., when the complainant was cleaning back side of his house, Sarabjit Singh cultivated land on back side of his house and his wife raised slogan to teach complainant a lesson. In the meanwhile, Lakhan Kesar armed with rod and Sarabjit Singh armed with sotta came towards the complainant. Sarabjit Singh caught hold of complainant, whereas, Lakhan Kesar gave a rod blow on the head of the complainant and again gave two more blows on his head due to which he fell down and became unconscious and thus, the present FIR.

Learned Counsel appearing on behalf of the petitioner contends

that there is no specific attribution against the petitioner; general and omnibus allegations have been levelled. He further contends that similarly placed co-accused have already been granted concession of regular bail in CRM-M-7025-2025 titled as 'Sanjay Vs. State of Punjab'; CRM-M-67462025 titled as 'Rajesh Kumar @ Raju Vs. State of Punjab'; CRM-M-266232024 titled as 'Shubham @ Shiva Vs. State of Punjab'; CRM-M-269162024 titled as 'Saurav Vs. State of Punjab'; CRM-M-13758-2025 titled as 'Ravi Kumar @ Bakra Vs. State of Punjab'; CRM-M-20319-2025 titled as 'Shivam @ Gunga Vs. State of Punjab' and CRM-M-26146-2025 titled as 'Vipan Kumar Vs. State of Punjab' vide order dated 11.07.2025 and to coaccused Lucky in CRM-M-52275-2025 titled as 'Lucky Vs. State of Punjab' vide order dated 31.10.2025. He further contends that the petitioner is in custody since 19.12.2023 and has already undergone an actual custody of more than 02 years. He further contends that there are total of 32 witnesses out of which only 01 has been examined so far. 4.

Learned State Counsel does not dispute the aforesaid facts. 5.

I have heard learned counsel appearing on behalf of the respective parties and have gone through the documents appended alongwith the present petition.

Taking into consideration the period of custody already undergone by the petitioner and noticing that the case of the petitioner would be identical to co-accused Sanjay, Rajesh Kumar @ Raju, Shubham @ Shiva, Saurav, Ravi Kumar @ Bakra, Shivam @ Gunga, Vipan Kumar and Lucky who have already been granted concession of regular bail as well as the stage of trial, I deem it appropriate to enlarge the petitioner on regular

bail to the satisfaction of the trial Court.

The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned. 8.

It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witnesses in any manner directly or indirectly.

The observation made hereinabove shall not be construed as an expression on the merits of the case and the Trial Court shall decide the case on the basis of available material.
