Present petition has been filed by the petitioner, seeking grant of regular bail, in case, FIR No.12, dated 09.01.2023, under Sections 302, 34 of IPC and Sections 25, 27/54/59 of Arms Act, registered at Police Station Sadar Rohtak, District Rohtak. 2.

As per the allegations, petitioner chased Manish (since deceased) to the agricultural fields, whereupon petitioner along with the co-accused caught hold of him, and petitioner allegedly fired gunshots at the chest of Manish. Thereafter, one country-made pistol along with one live cartridge was recovered at the instance of the petitioner. 3.

Learned State counsel has filed the status report in Court today and the same is taken on record.

Learned State counsel submits that although, the material witness has resiled from his earlier statement, but presence of the petitioner is reflected in the CCTV footage.

It is further submitted that merely on the ground that petitioner has remained in custody for the last three years and out of total 36 prosecution witnesses, only six have been examined so far, petitioner is not entitled to the concession of bail, particularly in view of the gravity of the offence.

In view of the submission made by learned State counsel that presence of the petitioner is captured in the CCTV footage, this Court does not deem it appropriate to grant the concession of regular bail to the petitioner, at this stage. Accordingly, present petition is dismissed.
