CRM-4074-2026 in CRM-M-71933-2025 This is an application under Section 528 of BNSS, 2023 for placing on record the statement of the complainant (Annexure P-13). For the reasons mentioned in the application, the same is allowed subject to all just exceptions and the statement of the complainant is taken on record as Annexure P-13.

Main Case:- The prayer in the present petitions under Section 483 BNSS is for the grant of regular bail in case bearing FIR No.264 dated 22.10.2022 (Annexure P-1) registered under Sections 302, 307, 506, 148, 149, 120-B of IPC at Police Station Jamalpur, District Ludhiana. 2.

Learned counsels for the petitioners contend that though as per the allegations, the petitioners and their co-accused assaulted Paras Kumar (deceased), the husband of the complainant - Shivani, during the course of the Trial, Shivani along with Sandeep Singh, Gurwinder Singh and Abhishek @ Abhi, the other material witnesses have not supported the prosecution case and have turned hostile. As the petitioners are in custody since the last more than 03 years, they be granted the concession of regular bail. 3.

The learned counsel for the State has filed custody certificates along with reply and the same are taken on record. He contends that all the accused including the petitioners brutally assaulted the deceased/Paras Kumar, who is none other than the husband of the complainant. He however concedes that all the material witnesses including the complainant have turned hostile and that the petitioners have been in custody for the last more than 03 years.

I have heard the learned counsel for the parties. 5.

Whether the remaining evidence available against the petitioners is sufficient to affix their liability shall be examined during the course of the trial. Admittedly, all the material witnesses including the complainant have turned

hostile. The petitioners are in custody since the last more than 03 years. The Trial of the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioners is not required. 6.

Thus, without commenting upon the merits of the case, the present petitions are allowed and the petitioners, namely, Sachin Kumar son of Vijay Kumar and Deepak Trehan @ Deepu son of Rajinder Kumar Trehan are ordered to be released on bail to the satisfaction of the Trial Court/Duty Magistrate concerned.

The petition stands disposed of.
