The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to Deputy Commissioner, Ludhiana to act upon report dated 01.10.2025 and take appropriate action in accordance with law.

The petitioner filed civil suit wherein interim stay vide order dated 01.04.2024 was granted by Civil Court. He vide letter dated 02.04.2024 requested SHO PS Dhillon to get construction stopped. In violation of orders of Civil Court, the respondent registered sale deed. He vide letter dated 19.04.2024 requested Chief Administrator, Greater Ludhiana Area Development Authority that despite stay order sale deed has been registered. He filed representation to Deputy Commissioner, Ludhiana who marked inquiry to Sub Divisional Magistrate (East). The matter was inquired and Sub Divisional Magistrate (East), Ludhiana vide report dated 01.10.2025 concluded that officials have registered sale deed in violation of Court orders.

Learned State counsel submits that inquiry report was prepared without granting opportunity to one of the affected parties. Accordingly, matter is under re-consideration. 4.

Learned counsel for the petitioner submits that matter has already been reconsidered still no action has been taken. 5.

Heard the arguments and perused the record.

The petitioner with respect to alleged violation of Court orders by Government officials has remedy to file contempt petition. The Department is also supposed to take an appropriate action if it comes in the inquiry report that officials were guilty of alleged misconduct. As per petitioner, inquiry report is final and everyone has already been heard. 7.

The petition stands disposed of with a direction to Deputy Commissioner, Ludhiana to examine the matter and take an appropriate action within 8 weeks from today. It is made clear that this Court has not expressed any opinion on merits and authorities would proceed in accordance with law.
