HARPREET SINGH BRAR J. (Oral) CM-19513-CWP-2025 Prayer in the instant application filed under Section 151 of CPC is for placing on record the document as Annexures P-6 and P-7, respectively.

Allowed as prayed for subject to all just exceptions. CWP-37834-2025 (O&M) 1.

Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the impugned inquiry report (Annexure P-3) and impugned punishment order dated 29.01.2025 (Annexure P-4) and as a consequence thereof, recovery effected from the petitioner may be refunded with interest @ 9% per annum. It is further prayed that during the pendency of the writ petition, the operation of the impugned order dated 29.01.2025 (Annexure P-4) be stayed.

Learned counsel for the petitioner submits that he would be satisfied if the legal notice dated 19.05.2025 (Annexure P-5) of the MOHD YAKUB 2025.12.23 16:51 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court, Chandigarh.

CWP-37834-2025 petitioner is decided by respondent No.1 by passing a speaking order in a time bound manner.

Learned counsel for the respondents, appearing on advance notice, submits that he has no objection, in case a direction is issued to the respondent No.1 for time-bound consideration and decision of the legal notice dated 19.05.2025 (Annexure P-5) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.1 is directed to consider the legal notice dated 19.05.2025 (Annexure P-5) of the petitioner and pass a speaking order in the light of the Instructions dated 19.05.2011 (Annexure P-6) and the judgment rendered by this Court in CWP-26799-2014, titled as Sushil Kumar vs Punjab State Power Corporation Limited and others, decided on 05.10.2018 (Annexure P-7), after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.1. 5.

Disposed of, accordingly.
