Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing and setting-aside the order dated 11.05.2016 (Annexure P-3) whereby the services of the petitioner were dismissed in pursuant to conviction order dated 23.02.2016 (Annexure P-2). Further a writ of mandamus has been sought, directing the respondents to reinstate the petitioner in service of the respondent/department in pursuance to the acquittal of the petitioner in the criminal case vide order dated 07.01.2019 (Annexure P-4) and thereafter acquitted in another case vide order dated 22.05.2025 (Annexure P-6) with

continuity of service and accrued benefits and protection of seniority. Another prayer has been made to direct the respondent to treat the dismissal period of the petitioner as duty period as the petitioner has been acquitted of the charges framed against him vide order dated 07.01.2019 (Annexure P-4) and 22.05.2025 (Annexure P-6) and to release all the accrued benefits including the salary of dismissal period and other benefits i.e. annual increments of the petitioner along with interest @ 18% per annum from the date it became due till its actual payment.

Learned counsel for the petitioner submits that he would be satisfied if the representation dated 01.09.2025 (Annexure P-8) of the petitioner is decided by the respondent by passing a speaking order in a time bound manner.

Learned counsel for the respondent, appearing on advance notice, submits that she has no objection, in case a direction is issued to the respondent for time-bound consideration and decision of the representation dated 01.09.2025 (Annexure P-8) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent is directed to consider the representation dated 01.09.2025 (Annexure P-8) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be

conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent.

Disposed of, accordingly.
