The present petition has been filed by the petitioner for grant of anticipatory bail in case arising out FIR No.91 dated 07.05.2025, registered under Sections 108, 115(2), 123, 126(2), 127(2), 190, 191(2) and 351(2) of the BNS, at Police Station Sector-14, Gurugram. 2.

Vide order dated 19.12.2025, passed by this Court, the petitioner was granted interim bail and was directed to join investigation. 3.

Status report has been filed. Learned State counsel on instructions from the Investigating Officer has submitted that the petitioner has joined investigation on 22.12.2025. However, for the purpose of conducting detailed investigation in the matter, custodial interrogation of the petitioner is required and it is, therefore, submitted by him that the petitioner does not deserve to be extended the benefit of pre-arrest bail. Given the nature of the allegations as levelled against the petitioner, this Court is of the considered opinion that no case for pre-trial incarceration of the petitioner is made out. Pre-trial incarceration even otherwise should not be a replica of post conviction sentencing. Accordingly, the present petition is allowed and the order dated 19.12.2025 granting interim bail to the petitioner is made absolute, subject to compliance of conditions laid down in Section 482(2) of BNSS. 6.
