The present petition has been filed for seeking directions to the respondent No.2 to protect the life and liberty of the petitioner at the hands of respondent No.4 who is allegedly harassing and threatening the petitioner regarding implication in false criminal case. 2.

Learned Counsel appearing on behalf of the petitioner contends that the petitioner is a vegetable vendor and has not been involved in any criminal case. He contends that respondent No.4 implicated the petitioner in a false case on the allegation of possession of 06 grams of Heroin. He contends that the police officials picked up the petitioner from his house in the morning on 07.11.2025. On the enquiry made by the co-villagers, it was informed that the arrest was required for the purposes of an inquiry in

!1 * connection with an ongoing complaint. Later, he was implicated in FIR No. 329 dated 07.11.2025 at 09:27 A.M. It is contended that the petitioner has been taken into custody without any fault and merely for concerned officials to get promotion benefits under the drive "Yudh Nashaya Virudh". He submits that he was granted regular bail in the aforesaid case on 02.12.2025 by the Special Court, Malerkotla. He contends that he had been illegally detained and implicated in the aforesaid case. It is contended that the respondent No.4 is thereafter threatening the petitioner to implicate in another NDPS case and is blackmailing on the said pretext. A representation dated 15.12.2025 was accordingly submitted by him to the Senior Superintendent of Police, Malerkotla but no decision has been taken thereupon. Apprehending threat to his life and personal liberty, the present petition has been filed. He submits that pursuant to completion of investigation in FIR No. 329 dated 07.11.2025, a final report has already been filed and the petitioner is facing trial in the said case. 3.

I have heard learned Counsel appearing on behalf of the petitioner and have gone through the documents appended alongwith the present petition.

A specific query was put to the Counsel for the petitioner as to any motive/reason for respondent No.4 to falsely implicate the petitioner, he is not in a position to respond to the same. In the given circumstances, this Court finds no reasons to accept the vague and omnibus allegation levelled by the petitioner against respondent No. 4 regarding threatening false implication in a criminal case. The possibility of an accused levelling allegations against police official(s) only to pressurize the police agency to not initiate any action against him so that he may continue to carry on his

!1 + trade and in the event of being apprehended, cite the present petition as a cause for implication so as to claim amnesty cannot be entirely ruled out. 5.

A direction to grant protection of the life and liberty of an individual would not ordinarily be issued unless there is real and tangible threat to the life and liberties of an individual. The same is not an escape or defence mechanism against officials initiating action against criminals. 6.

Finding no grounds to issue any such direction, the present petition is dismissed.
